    If she was not breaking the law then he had no right to arrest her. In essence it was false arrest (if not kidnapping) depends on the state law of the jurisdiction. Cop may get around this by finding a judge to agree that she was loitering or otherwise technically committing some misdemeanor by a stretch of logic and/or fabrication. Otherwise, she also has a potential civil federal claim for unreasonable search and seizure/civil rights violation under the 4th Amendment.

    What surprises me is not that this happened but that the cop didn't squeeze the cuffs so tight to make her wince and then beat her down and charge her with felony "resisting arrest". Its a sad but all too comon state of affairs (especially in the south) but pragmatically speaking she got off easy.
