Just vs Fair

I wonder what function that's intended to uncover? I've been thinking about it and I have no idea which one I think is more important. I think both are extremely important, and when they conflict it depends on the situation which one is best....

Assuming a democratic system:

Justice and fairness are both constructs of the same society. Fairness is fluid. Justice is more rigid.

When they collide, the construct of Justice can be altered by a vote of majority. Fairness on a democratic scale will always prevail over justice because of this.

If properly maintained, Justice is therefor an extension of fairness.
