Default Police Required Search Warrants to Look Through Cellphone Contents

    Full Text

    Excerpt by NYTimes

The Case is Riley V. California. I asked a professor a few months back about what he thought about the case. His answer? More than likely the police would win the case because a lot of court cases have defended the "invasion" of privacy, like cellphones, because the information gleaned from them could be very important to police investigation (you know.... danger of life, property, etc.)

Well, this would completely blow his expectations because the court ruled 9-0 that police are required to get a warrant to search such information. And besides that, police already uses tools to get back any deleted incriminating information from a suspect. It's like thinking one has deleted all files by clearing the recycle bin, but in reality, that information is still there.

    *swoon*

I fucking LOVE legal consensus like this. It's sooooo satisfying and gratifying. Shows in as explicit and direct of a way as possible what is right, and there truly is no dispuiting it. The system works! (in this case anyway).
