    Nice to see California brought down a notch.

    Ever since I found out the state funds drugs and surgery for sex changes, even for minors!, I have the desire to force them to secede from the US.

    Change starts off very slowly, perhaps with new movie by Meryl Streep, and very slowly builds momentum, and then at the end there is an exponential rush, and the change seems to happen all at once.

    The Ninth Circuit (to the best of my current understanding) will be rehearing the case en banc on appeal from the decision several days ago.

    We've legally made peace with the "to keep" portion of the 2A with the Heller and McDonald decisions.

    The question now is dealing with the "and bear" portion. The case under discussion here seems to be doing just that.

    If the Ninth Circuit hears it en banc (meaning that they will select 11 judges randomly from that circuit to hear it) then I would not be too surprised if they don't come to the same conclusion. This question has been dealt with differently in other jurisdictions, and as such, I would not be surprised if the issue made it to the Supreme Court (as often happens when the lower courts are split on a constitutional issue like this).

    For now, what matters is who the 11 random judges end up being. That will go a long way to determining how they decide the case.

    I recommend the Volokh Conspiracy blog at the Washington Post for further reading on the subject.

    In my opinion, the "good cause" provision of the law in question amounts to an unconstitutional constraint on 2A rights because it gives subjective discretionary authority to whoever issues the licenses.

    I think the courts (after an extended period of time no doubt) will come to the same conclusion.
