    As long as he's incarcerated, hence no longer a danger to society, what difference does his classification make? He's blatantly insane.

    He will be up for re-evaluation every three years and might, at some point, get out again. Justice would be served, but revenge would rather have him imprisoned for life.

    Okay, then the possibility of being released would bother me too. Without the capability of mind reading, no psychological evaluation can source out a sociopath and a clever sociopath could easily manifest the symptoms of being a paranoid schizophrenic. And even if he's a paranoid schizophrenic, if he's released, who will ensure he's on meds if he goes into hiding?

    If he is insane, he should be treated as such. If the treatment for insane murderers is inadequate, it should be revised. But to declare him sane just because the consequences of regarding him as insane are undesirable is, well, not just.
