    She didn't get harmed from ordering coffee. She was harmed by her misuse of a hot cup. I wouldn't let TK handle my hot coffee. Why? It could burn him!

    I also wouldn't let anyone handle a cup of coffee that might lead to 3rd degree burns. That's the point.

    That's not the point. I doubt this would have been an issue if the woman scorched her tongue. People handle hot liquids all the time. Carefully.

    Because they don't spill it on themselves.

    Really an entire product needs to be marketed on the one exception that may spill it? Not to mention a younger individual would have probably gotten up, and not received such crucial burns. Just like if the woman had sipped it, she would only have scorched her tongue.

    Name one person that hasn't spilled a hot drink on themselves.

    Is the result skin grafts?

    If it is, then the lawsuit has no merit.

    Here's the crux of the entire thing: the harm caused. It's not that someone spilled coffee and got burned a bit. It's that someone spilled coffee and suffered 3rd degree burns and needed skin grafts. It's the degree of harm caused, directly related to the procedures of the defendant.

    This is a clear cut case of negligence.
