Default Woman falls asleep on plane, sues...

Ferndale woman suing after she fell asleep on plane - Yahoo! News

Ginger McGuire was aboard a United Express flight from Washington, DC to Philadelphia. She says she fell asleep during the flight. It landed shortly after midnight Tuesday but no one woke her up until a cleaning crew found her four hours later.

United Airlines says they are working with a regional partner carrier to determine why the plane wasn't cleared upon landing.

McGuire told reporters, "I fell asleep on the plane and next thing you know I wake up, it's 4:00 in the morning. Nobody's on the plane. Nothing."

McGuire has hired Geoffrey Fieger who is filing a lawsuit for false imprisonment, emotional distress and negligence.

I remember there being a lot of problems with buses with kids falling asleep and not getting off on their stops, but seriously, this is a grown woman...

I dunno, it might make sense if she had been accidentally flown somewhere else. "WTF how did I get to Frisco?!"

    Dude.
She's suing for that? Next time, don't take so many sleeping tablets, so you'll wake up when every one gets off the plane.
Although I think it's kinda stink, that she was left on the plane (It's actually really funny.) I wouldn't trumpet it on the media! I'd be too embarrassed. Every one thinks 's an idiot now. A greedy idiot.
When I used fall asleep on the bus, after a 13 hour night shift, some of the regular passangers who recognised me would wake me up at the last stop (I'd set an alarm just in case, but traffic at 8am in the morning can unpredictable), but I would hardly turn around and sue the bus company if I missed my stop. Besides, I didn't expect it...any way I had a flat mate who'd notice if I didn't get home before she left for work, she'd give me a call. It's not the end of world any way.
Currently submerged under an avalanche of books and paper work. I may come back up for air from time to time.
Real life awaits and she is a demanding mistress.

I'm sure if she asked the person next to her nicely they would have woken her up when the plane landed.

If there wasn't someone next to her, I'm resentful because I have never been on a not completely packed flight since 9/11.

Dude, she's gonna end up owing her lawyer a ton. Even if she did win her damages would be, like, maybe a couple hundred bucks.

Edit: Meh, once again I fail to gain key info from not watching a video. I'm guessing the attorney did pick her up as on a contingency basis (he only gets paid if she wins) but only because he saw the opportunity to get media exposure... not because he actually expects to win anything.

Actually she has a good case.

Airlines are supposed to check the plane right after the plane lands, I think a head count may even be part of the flight cabin's close out duties. Until you are off that plane you are their responsibility to get to your destination safely.

This woman was healthy and young. The airline was lucky.

If something had happened to the woman in the interim because she was ailing/sick etc., the airline would be SCREWED right now.

There was a a similar story of an older man escorted from his flight to the curb outside to wait for his shuttle. His shuttle never came and he sat outside for at least 2 days straight, urinating and possibly defecting on himself, no food, no water, until airport authorities realized what had happened. He was on video surveillance the entire time. People passed by him consistently for 2 days. His family was very distraught once they found out what had happened to him.

I'm pretty sure the man or his family got some kind of compensation for that oversight.

Considering it was 3 or 4 am she probably did suffer 'mental and/or emotional distress'. She probably felt like she were in some kind of twilight zone episode.

Airline should charge her for room and board because she thought it was a bed room obviously.

I'm rooting for her, actually. Ridiculous stories about american judicature are quite popular around here.

She may have a case it depends on the specific facts.

Even though actual damages are low. The cost of litigating the case is probably $10-$15k. So she might get a few thousand in a settlement.

Her attorney is getting worldwide publicity on this case.

You should check out his website it's hilarious.
