    That's not a problem with the concept. It's a failed implementation. It fails because power corrupts. It fails because people are imperfect. That's why concepts are better than people.

    Hmm I guess this is where concentration span pays off no?

    Anyway, that's an (ineffective) remedy, not an alternative to democracy.
    The idea would be that any litigation would be treated with urgency and that the country would be left in the hands of the second choice party whilst any litigation is pursued. Mind you this would lead to the tactic of trying to oust the government by lodging allegation after allegation... obviously some detail work would be required but I'll be damned if I'm doing it!!!
    You could argue either way on those.
