    The CA court already ruled once that the majority will of the voters in CA meant nothing, and interpreted the constitution last time they moved to ban gay marriage to mean that such a ban would infringe on equal rights (or something to that effect). So they overturned it. Voters weren't going to have that, so they drafted another proposition, this time to change the state constitution. The issue is the same judges will likely argue the amendment by saying it conflicts with what is already present in the constitution (the part that goes into equal rights). However, it is all in the interpretation by the judges currently in place, and it is all being hotly debated. If they overturn the public vote a second time, the public may very well have them removed. Our governor is certainly advocating that they continue to fight against it, so this battle will probably be long and bloody (metaphorically speaking).

    not really... no one really cares that much. unless people think gay education enters the school curriculum.

    Stuff like this shouldn't be up to the public to decide at all. You had the same exact situation going on in Alabama, where they didn't repeal the interracial marriage ban until 2000. When the citizens are looking to harm and discriminate against specific groups, democracy is not what should be gone to for the solution.

    Yes, it is. That is why we have 50 separate states. The choice of where you want to live and under what laws is given to you by the existence of 50 individual states. No, I don't think a ban on interracial marriage was good, but it wasn't a federal law or a law in every state either.

    So if you don't like the laws, spend money moving? Majority rules, so if you don't like what they want, then stfu or gtfo?

    The majority of a population does not have the right to infringe on the rights of the minority.

    That is what we call freedom of choice. That is the freedom of choice we have in in America. It is the same freedom of choice that lets some states have gay marriage now.
